He acknowledged it's a gray area but said if they get called out for a shot cougar with a .357 hole in it, someone's getting a ticket.

A few years ago I took my dog out to a WMA to give her a run and we were quite a ways into our walk when a pack of dogs came running through. Luckily I don't think they saw us as they were on a dead run heading who knows where. I had to wonder what would have happened if they decided to check us out and I'm standing in the middle of a WMA with nothing to defend myself and nowhere to run.

Now, that doesn't mean a person can carry illegally, but there should be an acknowledgement and understanding of why a person would want to carry on public lands and it is much more important than worrying about someone taking game with their sidearm.

My question is does anyone who has replied to this thread so far actually have the MN permit to carry a handgun? Why are so many here arguing through your keyboard about this? For those that choose to carry a handgun while bowhunting without a permit to carry, you go right ahead. And then when the CO tickets you, and or arrests you for doing so, you can come back here to HSO and start a thread whining about how you were 'unfairly' arrested by a LEO. This isn't rocket science, folks. And yes, I actually did talk to the DNR in St. Paul, back when the law was changed about this. I do have the, PTC by the way. I was told no handgun carry while bowhunting for deer, without the permit to carry. That is also what is what is printed in the regs. books. Simple, really. But some of you 'lawyers' know better, right?

The debate eclipsed the bowhunting point some time back, transitioning to the question whether or not hunting in general allows you to carry a concealed pistol without a carry permit.

here is the Minnesota Statute concerning carrying a pistol without a carry permit while hunting. It is legal with the exception of Bow Hunting as previously stated.

624.714 CARRYING OF WEAPONS WITHOUT PERMIT; PENALTIES.

Subd. 9.Carrying pistols about one's premises or for purposes of repair, target practice.

A permit to carry is not required of a person:

(4) to carry a pistol in the woods or fields or upon the waters of this state for the purpose of hunting or of target shooting in a safe area; or

97B.211 HUNTING BIG GAME BY ARCHERY.

Subdivision 1.Possession of firearms prohibited.

(a) A person may not take deer by archery while in possession of a firearm.

(B) Paragraph (a) does not apply to a person carrying a handgun in compliance with section 624.714.

The law is pretty clear that you can carry a pistol while hunting (with the noted archery stipulations).

However, what's not clear is if the carry provision in the hunting regs overrides the State requirement to have a carry permit if you want to conceal the pistol while hunting.

The word 'conceal' doesn't seem to be contained in any statute relating to firearms. IMO you don't need to conceal a pistol if you have a permit. IMO you can conceal a pistol if you have a permit. IMO you don't have to conceal a pistol while legally hunting. IMO you can conceal a pistol while legally hunting.

All of my opinions take into consideration the prohibition to carry a pistol while archery hunting deer except for those who have a carry permit.

I have a valid carry permit.

I am a retired prosecutor and specialized in deal with gun crimes, including charging hundreds of cases, writing a book on the subject and lecturing on the laws relating to firearms and weapons.

A permit to carry is not required of a person:

Therein lies the grey area which one will most likely get prosecuted in this fine state.

In my scenario above I was merely on a walk with my dog on a WMA. This does not fall under "hunting" nor "target shooting". If I would have happened to be carrying and Barney showed up to shake me down, I'd probably have been issued a ticket or hauled to the big house...most likely under the presumption of some sort of terroristic threat to tweety birds or another trumped up charge in their war against the 2nd to make me a felon and remove my rights of gun ownership (which is their ultimate goal anyway). Undoubtedly Barney would also shoot my dog for licking his hand, claiming it was a threat to an officer's safety and well being, but more so to avoid having to deal with boarding it while they hauled me in.

No problem if you had the permit to carry. You would be legal to carry while walking your dog unless the park you were in bans guns all together.

You're changing the parameters of the scenario. If you look at what I quoted of Tom's this has nothing to do with the permit aspect.

But IF you have the permit to carry, my understanding is that you are only LEGALLY prohibitted from carrying in schools, federal buildings, etc., NOT parks, even if they are posted as 'HappyLand Park Bans Guns'. Further, if said park is posted as banning guns, and you have a permit to carry, and you are carrying, and you were asked by park to leave, and you refused, you would be facing a civil trespass charge rather than any criminal charges. Correct?

This is so simple:

Non-archery hunting: Carry open or concealed, no permit required.

Archery hunting: PTC required, carry open or concealed.

Minnesota is a Permit to Carry state, not concealed carry. I sometimes carry concealed, but other times I open carry. To be honest, most people don't even notice my pistol when I open carry.

Sorry LMIT, I reread and saw where it was and I was just saying that if one had PTC none of this would be a problem in the first place.

Not trying to change anything and I will not worry as I have my carry permit and will let others worry about it, and I will exercise my right as a permit holder when I deem necessary.

Carry permit here as well.

Hey, you never know when you might want to take your pistol out and target shoot in the woods if you're not flushing any grouse.

Carry it on you in the woods/fields/streams/lakes whatever... while hunting (not bow hunting) and don't worry about it.

Wow this thread went off course, it went from a permit to purchase conversation to arguing about conceal to carry lol.

Besides no one even bothered to ask where I would be hunting, it isn't in MN it is in the Yooper. I seen alot of bear sign on the property and when we were camping we had wolves all around us. If I go deep into them woods up there I'm gonna be packing some heat.

I am also deer hunting in the Upper Peninsula during the firearms season. I was informed that I needed a Concealed Carry Permit to use a pistol. Are you saying that a Permit to Purchase is also acceptable?

LOL no I doubt it.

Permit to Purchase is just to buy the pistol, thats the whole reason why I started this thread. It then kind of drifted off into a Conceal Carry debate and MN laws.

      On the south end...   The big basin, otherwise known as Big Traverse Bay, is ice free.  Zippel Bay and Four Mile Bay are ice free as well.  Everything is shaping up nicely for the MN Fishing Opener on May 11th. With the walleye / sauger season currently closed, most anglers are targeting sturgeon and pike.  Some sturgeon anglers are fishing at the mouth of the Rainy River, but most sturgeon are targeted in Four Mile Bay or the Rainy River.  Hence, pike are the targeted species on the south shore and various bays currently.   Pike fishing this time of year is a unique opportunity, as LOW is border water with Canada, the pike season is open year round. The limit is 3 pike per day with one being able to be more than 40 inches. All fish 30 - 40 inches must be released. Back bays hold pike as they go through the various stages of the spawn.  Deadbait under a bobber, spinners, spoons and shallow diving crankbaits are all viable options.   Four Mile Bay, Bostic Bay and Zippel Bay are all small water and boats of various sizes work well. On the Rainy River...  Great news this week as we learned sturgeon will not be placed on the endangered species list by the U.S. Fish and Wildlife Service.     The organization had to make a decision by June 30 and listing sturgeon could have ended sturgeon fishing.  Thankfully, after looking at the many success stories across the nation, including LOW and the Rainy River, sturgeon fishing and successful sturgeon management continues.   A good week sturgeon fishing on the Rainy River.  Speaking to some sturgeon aficionados, fishing will actually get even better as water temps rise.     Four Mile Bay at the mouth of the Rainy River near the Wheeler's Point Boat Ramp is still producing good numbers of fish, as are various holes along the 42 miles of navigable Rainy River from the mouth to Birchdale.   The sturgeon season continues through May 15th and resumes again July 1st.   Oct 1 - April 23, Catch and Release April 24 - May 7, Harvest Season May 8 - May 15, Catch and Release May 16 - June 30, Sturgeon Fishing Closed July 1 - Sep 30, Harvest Season If you fish during the sturgeon harvest season and you want to keep a sturgeon, you must purchase a sturgeon tag for $5 prior to fishing.    One sturgeon per calendar year (45 - 50" inclusive, or over 75"). Most sturgeon anglers are either a glob of crawlers or a combo of crawlers and frozen emerald shiners on a sturgeon rig, which is an 18" leader with a 4/0 circle hook combined with a no roll sinker.  Local bait shops have all of the gear and bait. Up at the NW Angle...  A few spots with rotten ice, but as a rule, most of the Angle is showing off open water.  In these parts, most are looking ahead to the MN Fishing Opener.  Based on late ice fishing success, it should be a good one.

      Crazy windy again today.... This is has been the norm this spring. Between the wind and the cold fronts, fishing has been more challenging for me than most years.  Panfish have been moving in and out of the shallows quite a bit. One day they are up in the slop, the next they are out relating to cabbage or the newly sprouting lilly pads.  Today eye guy and I found them in 4-5 ft of water, hanging close to any tree branches that happened to be laying in the water.  Bigger fish were liking a 1/32 head and a Bobby Garland baby shad.   Highlight of the day way this healthy 15incher
