Sometime Monday night or Tuesday Morning, somebody hit my bosses dog and just left it, luckily they found the dog and got it to a vet, haven't heard the status yet. It was hit on Waconia Parkway between highway 10 and the lake. If anybody saw anything and got a description please contact me @ [email protected]

Thank You

Sorry to hear the bad news. This is the same route I take unless I need bait at Mases. I drove through there on Tues AM around 7:45 am to get to the Wagener access, sorry- I did not see anything. I will check with the neigbors who fish Waconia.

People need to take responsibility for thier actions!!

Just for your info....

First....

It is not illegal to leave the scene of a collision with an animal unless you're going to try to claim damage on your insurance.

Second....

The dog shouldn't have been in the road.

Third....

I'm very sorry that the accident occured. Hopefully the owner learns his lesson to keep the dog off the road.

Fourth....

Everyone that knows me knows I am a dog lover. I have two. I am not saying the guy shouldn't have stopped and checked tags to contact the owner.......but, my experience has been that injured animals are very unpredictable and you SHOULD NOT approach an injured animal unless you're either sure it's dead or you know the dog. An accident with a motor vehicle and a dog is NOT the drivers fault unless the dog was at a crosswalk with a "Walk" light.

I would have checked it out too.

I am just saying that there is nothing "wrong" legally with leaving the scene.

If I hit a 200 pound pit bull, I still would have stopped at the closest house or closest couple of houses to see if I could find the owner and I certainly hope others would do the same. I had something similar happen to me that certainly WAS my fault and it still sucks regardless of whose fault it was.

http://fishingminnesota.com/ubb/Forum30/HTML/003595.html

However the purpose of this post was obviously to track down the person driving the car.............

I am simply stating that there is no legal recourse for going after the driver. Even if a witness said he swerved to hit the dog, it would be impossible to prove.......because it is ultimately the owners responsibility.

If it was in the city limits, there is most likely a "leash" law anyway.

One morning, while driving into work, I ran over a cat. I was in the heavily populated suburbs.

I stopped and checked the cat. It was dead. As I was getting ready to jump back into my car, a cop pulls up behind me. Gets out and asks me what I'm doing.

Told him I ran over the cat and that it wasn't my fault, nothing I could do. I was in heavy traffic and the cat ran out in the street.

He asked me where I was going and I told him to work......

He said no, that I needed to find out who the owner was and atleast tell the person out of courtesy, that the cat is dead.

He looked at the tag, placed some calls, and found out that the owner's home was right there. He told me to go and tell the owner what happened. I told him that I needed to go to work, he said no. I said I will, only if he goes with, because I didn't want any trouble.

I rap on the door and this old lady shows up. TOUGH SITUATION!!!!!! I told her what happened and she began to cry. Feeling like total crap, I opened my wallet and gave her $50. I told her that I was sorry, but that maybe she could go to the animal shelter, and save a cat by buying it.

She thanked me and closed the door. The cop was standing behind me and when I turned around. He asked me what I was doing. I told him that I gave her some money to buy a new cat. He said to wait and he went to talk to the lady.

Before I knew it, he was arresting her!

I asked him what the heck was going on and he said that he was arresting her for selling her pussy to me for $50...........

I'm really sorry. I just couldn't help myself........I'm sure this is in bad taste.......but I do love this joke!!!!

It is too bad about your dog. I love mine and she is my buddy. If she got hit by a car, I would appreciate the courtesy of someone telling me what happened. It isn't the driver's fault......

C'mon guys, this is getting out of hand.

WWG did show some compassion and said it basically sucks. But reading this thread has indicated two things. 1. that people want to go after the person that hit the dog. As WWG mentioned, there isn't anything you could do about it based on law.

2. People are now going after WWG for his so called lack of compassion. I know WWG and have seen both of his dogs. He definitely is a dog lover. I don't think he is trying to be uncompassionate, but just trying to point out that it's not the driver of the vehicles fault or cannot be held acountable.

There was no mention on how the dog came to be where it was at the time, so I think this topic should just be dropped.

Here's a quote that I found. I am glad no one was behind me when my dog jumped from my truck a while ago (I posted a link to that thread in one of my previous posts).

"Besides the dog bite cases that have occurred because of dogs running at large, there have been less obvious lawsuits deriving from "dogs running at large" violations. For instance, a driver is injured while avoiding a loose dog, because he had hit another car or some other hard object. That driver can now bring a lawsuit against the owner of that dog.

While some ordinances or codes specifically mention or require a leash on a dog when the dog is in publicly permitted areas, such as the ordinance described earlier in this article, there are other municipal ordinances that make no mention of utilizing a leash, but simply state that the handler shall keep the dog under control. There are other ordinances, while mentioning "leash," mention "leash" in the disjunctive descriptive form such as, "The owner shall keep the dog on a leash, chain or some other device to control the dog." "

Yep.....time to actually do some work at work.

Again;

I know this joke was in bad taste. BUT, it is funny.

I lost a dog a few years back that got hit by a car. The guy came to the door, with the dog. He felt bad, but it wasn't his fault. We talked and I told him that it was ok. He was a neighbor. I had to put the dog down. It was icy conditions, and I was glad he didn't crash to avoid the dog.

Sorry about the dog? Maybe there person did stop and didnt know what to do? Maybe he or she had to be somewhere important? I love dogs and I feel bad, but I would rather have someone hit an animal head-on instead of swerving into another car and killing some kids.

The joke had me going.

Unfortunatly your right, but sometime dogs get loose through no fault of their owners.....

Posted

Come on... It isn't a legal issue, it's about having a little decency. I've had two dogs get hit by cars. Both times it wasn't my fault and both times the drivers didn't stop. Both times it would have gave me a little piece of mind to know that the driver didn't swerve to hit my dogs. And had the driver of the first one stopped, I wouldn't have found a pile of guts. The only way I knew it was my dog was because of the dog tags. The least someone can do is report it.

well said duey. SPRUNG

Posted

Duey, please tell me how it wasn't your fault?

If your toddler disobeyed you and ran into the street and got hit.....is it the toddler's fault.

Dog's don't know the dangers of a road.....so if your dog has access to the road than it's your fault. If the dog breaks out of its "area" through a fencehole, etc. then it's your fault for not having the proper restraints or conducting the proper training. What I want to know is how it happened twice?

Posted

The first time I was on vacation and neighbors were watching it. The second dog was on a rope in the yard but the loop on the collar broke. If you would like to think its my fault, that's fine maybe it is. That isn't my point.

Posted

OK FELLAS , IT SUCKS TO LOSE ANY PET.
WWG HAS A REALISTIC POINT, YOU ARE RESPONSIBLE FOR THE CARE OF YOUR PET. PERSONALLY, BEING A DOG OWNER, I WOULD HAVE STOPPED TO CHECK THE POOCH OUT, BUT SOME OTHERS MAY NOT. IM SORRY IT HAPPENED. HATE HEARING ABOUT DOGS BEING HIT. THATS ALL.
WALTER.

I would typically stay out of this but....

I own a dog, and I have a fenced in back yard. I let the dog out in the backyard for 4 years straight, gates shut, no problem. One day, the dog is gone, gates are still shut...I go looking for my dog, and watched as he nearly got hit by a car. I was lucky!

How did the dog get out? He jumped the fence. How was I to guess after 4 years that he'd suddenly jump the fence? There was no way.

Was this my fault? Very improbable.

Same dog, 2 years later, up north. My dog is out in the gravel road, and gets hit...I was right in the yard, trying to call him back. He didn't listen. My fault? Yes!

The driver that hit the dog??? I was standing right there in the yard...did he stop? No! Pretty gutsy guy.

Point: It isn't ALWAYS the owners fault. Circumstances dictate certain actions.

I'm sure I'll get flamed for this posting, but...

I must say that losing a pet is almost as bad as losing a family member(human). But I must admit, that unless I knew the person who's dog/cat I just ran over, I would not stop to notify the owners.

I would do this not because of lack of compassion, but because of the reality of the times that we live in today. Granted most people out there are good people, but we all know there are some real wack-o's too. And just telling them you killed their pet could send them over the edge.

I love pets dearly, and will never intentionally put one in harms way. But I will never risk my life over a dead animal, pet or no pet. I will try to avoid hitting an animal by slowing down, or steering around if it is safe. But never, never slamming on the brakes or swerving. That's how people die.

Sad situation, but it's just not the same world we grew up in.

WWG,
The dog owner isn't the one that needs to learn a lesson. Law or not, the compassionate thing to do is show some common courtesy and stop to help if you hit an animal. Everyones judgement day will come and good deeds can go along way in determining your future.

Danny Berg, sorry to hear about your bosses dog. Several years ago a dog ran into the side of my car as I was traveling 30mph. The dog was hurt bad, when I got out to help, the dog wanted to tear me apart. I got back into the car and followed the injured dog home. I knocked on the home owners door and asked if he owned a long haired black dog.He was more concerened why he should answer me than he was for the dog.I told him a dog ran into the side of my car and I followed it to his house. He immediatly began chewing me out and cussing. I turned and left. I am with waste water on this one but one question has been left out. What do you intend to do If you find this person? Play it safe and let it go. Ken

Posted

I was hoping that the person who did it might see this and send me an e-mail to try and contact the owner. Just out of common courtesy.
Wasn't trying to make such a big deal about who or what is to blame, or if there was any legal recourse. Some people assume too much on this site...

Nah, I'm not changing my guess. It's more fun to make early predictions and see how far off I am.   I'll turn on the hair dryer and see if it helps.

Because I temporarily changed the rules, and smurfy was the 2nd person to wager a guess, I changed his prediction to April 25th.  Also, since SkunkedAgain was the originator of this competition and was the 1st person to guess, I will give him until Friday to change his prediction if he wants to (although he may regret if the ice goes out on April 18th).  After him, no more "changes" will be allowed on my board.   Lots of "good" open dates available for those that have not predicted yet.  Updated board below:

https://www.timberjay.com/stories/moccasin-point-upgrade-has-longtime-users-concerned,22802   Moccasin Point upgrade has longtime users concerned DNR hopes to get major remake of key access underway later this year Posted Thursday, March 20, 2025 10:36 am   Marshall Helmberger LAKE VERMILION— With funding finally in place, the Department of Natural Resources is planning to move forward with an estimated $2-plus million renovation of the Moccasin Point landing, and users of the site say they’re concerned about the changes. The landing has been heavily used for decades by anglers, Boundary Waters visitors, residents of nearby islands and other remote-access properties on Lake Vermilion and, perhaps most critically, by emergency responders for everything from fire to medical response. Moccasin Point has also been a protected harbor for private barges loading and unloading as they service the many water-access properties in the area. Sarah Schmidt, who spends summers with her husband Jake at their cabin on nearby Pine Island, said there’s a lot at stake for people who depend on the landing. “A lot of people have designed their dream home around having access to that landing,” she said. “People need propane, they need lumber, and if they need to install a septic system, they need lots of gravel,” she said. For the many hundreds of island or other water-access property owners on the lake, all of that material comes by barge. Moccasin Point is particularly well suited for such use, since it is arguably the most protected harbor on Lake Vermilion, with islands and mainland protecting it from wind from just about any direction. It’s also centrally located on the sprawling lake and close to concentrations of island homes and cabins. Scott Kelling, northeast regional manager for DNR Parks and Trails, said the plans for the reconstruction of the landing are still being finalized, but insisted they will take into account the unique mix of recreational and commercial use of the landing, including use by all three of the barging companies that service customers on the lake. According to Kelling, the remake of the landing will include removal of the old pier and the reconstruction of a new one in nearly the same location. “The new pier will serve the same function,” said Kelling, and will include an additional ramp that will be dedicated for barge loading and off-loading. Kelling said an engineer’s inspection of the existing pier determined it was near the end of its useful life, although Schmidt said she thinks that opinion reflects the DNR’s desire to remove the structure rather than its actual condition. Kelling acknowledges that it’s not the only reason for replacing the structure. “With our redesign it’s just not in the right location,” he said. Adequate parking is another major concern of longtime users of Moccasin Point. Tim Logan, whose family has owned island property near the landing since the 1950s, said plans the DNR had shared a few years ago seemed to show less parking than is typically used at the site. Schmidt notes that during high-traffic weekends, the parking area is frequently full and overflow parking can extend for hundreds of feet along Moccasin Point Rd. She said she counted 163 vehicles parked at the landing at one point last Memorial Day weekend and said there are routinely 90-100 vehicles during the summer season. Many of the regular users of the landing, particularly those on island properties, use the site for long-term parking of their vehicles for days, weeks, or months at a time. That’s unusual at public landings, which are typically limited to day use. Kelling said the DNR is making an exception to that rule for Moccasin Point, given the many varied uses of the unique property. “Overnight parking will be allowed,” he said. Kelling said the current plan will allow parking for a bit over 100 vehicles, which is more than some original plans for the site. “We’re doing everything we can to maximize the parking there, at some considerable expense,” he said. Longstanding issues Kelling said the DNR’s plan for reconstruction is motivated by a desire to “manage the site more responsibly on a number of fronts.” The DNR acquired the site in 2008 and had planned to undertake reconstruction of the landing back in 2013 but lacked the funds at the time to accomplish the work. The funding was approved in 2023 and the DNR has been working on design of the project ever since. According to Kelling, the site has operated essentially as a “free-for-all” for years, with uses and resource impacts that aren’t typically permitted at DNR-managed access points. “There are currently a number of transgressions out there,” said Kelling, including long-term storage of personal property and building materials. He said the site, which slopes toward the lake, also contributes large amounts of sediment into Vermilion during heavy rainfall. “We need to better manage the stormwater,” said Kelling. “Currently, a lot of sediment and other things end up in the lake when it rains.” Schmidt questions whether the change will be an improvement, since the DNR’s reconstruction of the site will convert the existing grassy hillside that currently serves as the site’s parking lot into a paved parking area. Kelling said the parking area will be leveled before being paved and that stormwater will be directed into one of two planned stormwater ponds in order to contain sediment. Schmidt claims the ponds will become a mosquito breeding ground. Kelling said he expects the final design will be completed soon and he is expecting to hold an open house in early summer so interested users can see what’s planned for the site. He expects actual construction to begin sometime in October if all goes as planned. That initial work will include blasting of some underlying bedrock in order to level the site. But most of the work will take place in 2026, he said, and during that period, it may be difficult to maintain public use of the site, although he said use of the site by barges should still be possible, with potentially some minor delays. But he said other users of the site may want to explore other access options for that summer. Kelling said he hopes to have more information on that at the open house later this year. “A goal of the open house is to really share the timeline and alternatives for users,” he said. “They might need to park somewhere else in 2026.”
